Employers can commemorate their employees on their or the employer's milestone days with various gifts. A milestone day refers to typical milestones for both the employee and the employer. The employer can give gifts to their employees on their individual milestone days as well as on the company's milestone days. Examples of employee milestone days include 40th, 50th, 60th, and 70th birthdays, wedding anniversaries, over 10 years of service, or retirement.
A customary and reasonable milestone gift received by an employee is tax-free if received in a form other than money or a comparable payment (Income Tax Act 69 § 1 paragraph 3). Tax-exempt milestone recognition requires that the company follows a clear practice in giving gifts that applies collectively to the entire staff. The milestone gift must be chosen by the employer. However, a tangible gift or service freely selectable by the employee is considered a monetary payment. Nevertheless, the employee's ability to choose a gift from options predetermined by the employer does not make the gift taxable.
In addition to milestone gifts, employers can remember their employees with various other gifts. Only so-called "insignificant" other gifts given collectively to the entire staff are tax-exempt. An insignificant other gift mainly refers to small tokens of appreciation given to the entire staff at Christmas, for instance. The value of an insignificant gift can be up to 100 euros (including VAT). If the employer gives employees several insignificant gifts per year, the total value can be up to 100 euros. The gift can be an item chosen by the employer, a ticket, a service, or a personalized gift card. The employee can also choose the gift from options predetermined by the employer.
